This website, onnetsaqua.com (the "Site"), is operated by Onnets Aqua Design. Throughout the Site, the terms "we", "us" and "our" refer to Onnets Aqua Design.
These Terms of Service govern your access to and use of the Site and your purchase of products or services from Onnets Aqua Design.
By accessing the Site, creating an account, placing an order or purchasing from us, you agree to these Terms of Service together with any policies referred to on the Site, including our Privacy Policy, Shipping & Delivery Policy and Refund Policy.
Please read these Terms of Service carefully before using the Site. If you do not agree with these Terms, you should not use the Site or place an order.
SECTION 1 - ELIGIBILITY AND USE OF THE SITE
You must have the legal capacity to enter into a binding transaction when placing an order through the Site. If you are purchasing on behalf of another person, business or organisation, you confirm that you are authorised to do so.
You may not use the Site or our products for any unlawful or unauthorised purpose or in any manner that violates applicable laws or regulations.
You must not introduce viruses, malware, malicious code or other material that may interfere with the security, integrity or operation of the Site.
SECTION 2 - PRODUCT INFORMATION
We make reasonable efforts to ensure that product descriptions, specifications, images, dimensions, prices and other information displayed on the Site are accurate and up to date.
Product images are provided for illustration and product-identification purposes. Colours, glass appearance, lighting, reflections and finishes may appear differently depending on photography, screen settings, lighting conditions and manufacturing variations.
Product measurements, dimensions, capacities and specifications may be approximate unless expressly stated otherwise. Minor manufacturing tolerances may occur.
Where a product is available with optional components, accessories or upgrades, only the items expressly stated as included in the selected product or variation are included in the purchase.
For example, certain aquarium tank sets may include an integrated filtration system while covers, lighting, cabinets or other accessories may be optional depending on the product configuration selected.
Customers are responsible for reviewing the product description, dimensions, selected variation and included items before confirming an order.
SECTION 3 - PRODUCT AVAILABILITY
Products are subject to availability. We may limit quantities, discontinue products, change product variations or temporarily remove products from sale without prior notice.
If a product becomes unavailable after an order has been placed, we will contact you and, where appropriate, offer an alternative, revised fulfilment arrangement or refund for the unavailable item.
SECTION 4 - PRICES
Prices displayed on the Site are stated in Malaysian Ringgit (RM) unless otherwise indicated.
Our webstore pricing may differ from prices offered through third-party marketplaces, physical sales channels or other platforms.
Prices, discounts and promotions may be changed from time to time without prior notice. The price applicable to an order will generally be the price displayed and confirmed at the time the order is submitted, subject to correction of obvious pricing or system errors.
If an obvious pricing, calculation or system error affects an order, we may contact you before fulfilment to correct the error. If the corrected price is not acceptable to you, the affected item or order may be cancelled and any applicable payment refunded.
SECTION 5 - TAXES AND OTHER CHARGES
Applicable taxes, delivery charges and other charges will be applied or disclosed where required by law and, where applicable, shown before you confirm your order.
Nothing in these Terms should be interpreted as stating that a particular tax applies to every product or transaction where that tax is not legally applicable.
SECTION 6 - ORDERS
When placing an order, you agree to provide current, complete and accurate billing, contact and delivery information.
You should review your order carefully before confirming it, including the product, size, variation, quantity, delivery address and contact information.
After an order is submitted, we will provide an acknowledgement of receipt through the Site, email, messaging service or other available electronic means without undue delay.
An automated order acknowledgement confirms that we have received your order but does not necessarily mean that every item has completed final availability, payment or fulfilment checks.
We reserve the right to refuse or cancel an order where reasonably necessary, including where a product is unavailable, payment cannot be verified, information provided is materially inaccurate, there is an obvious pricing or system error, fraud or misuse is suspected, or fulfilment is not reasonably possible.
If we cancel an order after receiving payment and no alternative arrangement is agreed, the applicable amount paid for the cancelled item or order will be refunded.
SECTION 7 - ORDER CORRECTIONS AND CHANGES
The Site may provide options to review or correct order information before confirmation.
If you discover an error after confirming an order, please contact Onnets Aqua Design as soon as possible through WhatsApp or another available contact channel.
We will make reasonable efforts to correct errors or requested changes where possible. However, changes may not be possible once an item has been shipped, prepared specifically for your order or entered into production.
This section does not limit any rights available to you under applicable Malaysian consumer law.
SECTION 8 - PAYMENT
Payment must be made using one of the payment methods made available through the Site at checkout.
Payments may be processed through third-party payment service providers. Your use of a payment method may also be subject to the terms and conditions of the relevant payment provider.
We do not intentionally store complete credit card or debit card details on our own systems.
An order may be held, delayed or cancelled if payment is declined, reversed, incomplete, unauthorised or cannot reasonably be verified.
SECTION 9 - SHIPPING AND DELIVERY
Shipping and delivery are subject to our Shipping & Delivery Policy, which forms part of these Terms of Service.
Shipping availability, charges and estimated delivery time may vary depending on the product type, product size, delivery location, courier availability and other fulfilment requirements.
Free shipping is available on most eligible products within Peninsular Malaysia, subject to the product and delivery conditions stated on the Site.
Aquarium tanks and other fragile or bulky products may be subject to additional delivery restrictions because of their size, weight and fragile nature.
Aquarium tanks are generally not suitable for standard shipping to Sabah and Sarawak. Selected products or orders may be considered on a case-by-case basis. Please contact us before ordering if delivery to East Malaysia is required.
Estimated shipping or delivery times are estimates rather than guarantees unless expressly agreed otherwise.
SECTION 10 - DAMAGED, DEFECTIVE OR INCORRECT GOODS
We take reasonable care when preparing and packing orders, particularly aquarium tanks and other fragile products.
If you receive a product that is damaged, defective or materially different from what was ordered, please contact Onnets Aqua Design as soon as reasonably possible.
We may request clear photographs or videos showing the product, packaging, shipping label and relevant damage or issue so that we can assess the matter.
Where goods received are materially different or contain defects, we will provide an appropriate remedy in accordance with applicable Malaysian consumer law. Where required by law, Onnets Aqua Design will bear the applicable cost of re-delivery or replacement delivery.

SECTION 11 - RETURNS, REFUNDS AND CANCELLATIONS
Returns, refunds, replacements and cancellations are subject to our Refund Policy and applicable Malaysian consumer law.
Eligibility may depend on the nature of the product, condition of the goods, reason for the request and whether the item was made, prepared or customised specifically for the customer.
Nothing in our Refund Policy or these Terms is intended to exclude or restrict a consumer right or remedy that cannot lawfully be excluded under Malaysian law.
SECTION 12 - CUSTOM, MADE-TO-ORDER AND SPECIAL ORDERS
Certain products may be made, modified, configured or prepared according to customer-selected dimensions, specifications, finishes or other requirements.
Customers are responsible for checking and confirming all agreed specifications before production or preparation begins.
Requests to modify or cancel a custom, made-to-order or special-order product after confirmation may not always be possible once production, cutting, preparation or procurement has commenced.
Any restriction on cancellation or return of custom products is subject to applicable consumer law and does not remove rights relating to defective, damaged, incorrectly supplied or materially misdescribed goods.
SECTION 13 - THIRD-PARTY SERVICES AND LINKS
The Site may contain links to, integrations with or services provided by third parties, including payment providers, delivery providers, social-media platforms and other service providers.
Third-party websites and services are operated independently from Onnets Aqua Design and may be governed by their own terms, privacy policies and practices.
We are not responsible for the content or practices of third-party websites that we do not operate, except to the extent that responsibility cannot lawfully be excluded.
SECTION 14 - CUSTOMER CONTENT, REVIEWS AND SUBMISSIONS
If you voluntarily submit a product review, photograph, aquarium setup image, feedback or other content for publication or promotional use, you confirm that you have the right to provide that content.
Where you agree that submitted content may be published or used by Onnets Aqua Design, you grant us permission to display, reproduce or share that content for the agreed purpose, subject to applicable privacy and intellectual-property laws.
We may refuse or remove content that is unlawful, misleading, abusive, infringing, fraudulent or otherwise inappropriate.
SECTION 15 - PERSONAL INFORMATION
Your submission and our processing of personal information through the Site are governed by our Privacy Policy.
Please review the Privacy Policy for information about how Onnets Aqua Design collects, uses, protects and discloses personal information.
SECTION 16 - INTELLECTUAL PROPERTY
Unless otherwise stated, the Site and its content, including text, product descriptions, photographs, graphics, logos, designs and other materials, are owned by or licensed to Onnets Aqua Design and are protected by applicable intellectual-property laws.
You may use the Site for personal and lawful shopping or informational purposes.
You may not reproduce, copy, republish, distribute, commercially exploit or use substantial portions of Site content without our prior permission, except where permitted by law.
SECTION 17 - PROHIBITED USES
You may not use the Site for unlawful, fraudulent, abusive or malicious purposes.
You must not interfere with the security or proper operation of the Site, attempt unauthorised access to systems or accounts, introduce malicious software, impersonate another person, submit deliberately false information, misuse customer information or infringe the rights of Onnets Aqua Design or any third party.
We may restrict or terminate access to the Site where we reasonably believe these Terms have been seriously breached or the Site is being misused.
SECTION 18 - WEBSITE AVAILABILITY
We aim to keep the Site available and functioning properly, but we do not guarantee uninterrupted or error-free access at all times.
The Site may occasionally be unavailable because of maintenance, updates, technical problems, third-party service interruptions or circumstances beyond our reasonable control.
We may modify, update or discontinue Site features from time to time.
SECTION 19 - CONSUMER RIGHTS AND LIMITATION OF LIABILITY
Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy available to consumers under the Consumer Protection Act 1999 or any other applicable Malaysian law where such right cannot lawfully be excluded, restricted or modified.
To the maximum extent permitted by law, Onnets Aqua Design will not be liable for indirect, incidental or consequential loss that is not reasonably foreseeable and does not arise directly from our breach of a legal obligation.
We are not responsible for loss or damage caused by misuse, improper installation, unauthorised modification, failure to follow appropriate care or safety instructions, external impact, unsuitable support surfaces or other circumstances outside our reasonable control, except where liability cannot lawfully be excluded.
Customers are responsible for ensuring that aquarium tanks, cabinets, stands, flooring, electrical equipment and other components are installed and used on suitable surfaces and in accordance with appropriate safety requirements.
SECTION 20 - ERRORS AND CORRECTIONS
Occasionally, information on the Site may contain typographical, technical or administrative errors relating to product descriptions, specifications, prices, availability, delivery charges or other information.
We may correct such errors and update Site information when identified.
If a material correction affects an order you have already placed, we will contact you where reasonably necessary and provide an appropriate option in accordance with applicable law.
SECTION 21 - SEVERABILITY
If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be interpreted or limited to the minimum extent necessary, and the remaining provisions will continue to apply.
SECTION 22 - NO WAIVER
If Onnets Aqua Design does not immediately exercise or enforce a right under these Terms, this does not constitute a waiver of that right.
SECTION 23 - GOVERNING LAW
These Terms of Service and transactions made through the Site are governed by the laws of Malaysia.
Any dispute will be dealt with in accordance with applicable Malaysian law and the rights and dispute-resolution avenues available to consumers, including where applicable the Tribunal for Consumer Claims Malaysia.
SECTION 24 - CHANGES TO THESE TERMS
We may update these Terms of Service from time to time to reflect changes to the Site, our products, services, business practices or applicable laws and regulations.
When these Terms are updated, the Effective Date shown at the top of this page will be revised.
Your continued use of the Site after updated Terms are published will be subject to the updated Terms, except where applicable law requires otherwise.
